There are certain circumstances, fortunately rare, where mental health/therapy records are needed to fulfill a referral, insurance, or legal situation. Releasing records should never be taken lightly, as they are highly private and should remain so. Once released, often the recipient of the records has no confidentiality requirement. I have no control over how the record is used once it is released. Consistent with professional standards, HIPAA, federal and Texas state law, mental health records are destroyed after 7 years from last therapeutic contact/termination. There will be no records after 7 years. This standard of the field is intended to represent the balanced interest of clients.

Any release of records requires the client’s written consent, with the exceptions of a legal subpoena or an emergency that ethically or legally requires my release.
